Terms and Conditions |

All property is sold "AS IS," and ALL SALES ARE
FINAL. Property is open to public inspection and it
is the bidder's responsibility to determine
condition and usability before bidding.
|
A bid by any person shall be proof that the person
has made him/herself acquainted with the conditions
of sale and has agreed to be bound by them.
|
The auctioneer reserves the right to reject any and
all bids on lots for which there is no reasonable
opening bid offered. The auction staff has the right
to bid on items for themselves or on the behalf of
an Absentee Bidder.
Consignors can not bid
on their own items.
|
The auctioneer reserves the right to:
a) revoke the bidding privileges
of any person at any time; b) refuse any bid with a
fractional advance over the preceding bid; c)
choice, group, add to,
withdraw from or change
selling order or partial/full lots; d)
reopen the bidding in the
event of a tie or missed
raised bid.
|
All items must be removed within the time announced
at the sale at the purchaser's sole cost and risk.
If, for any reason, the purchaser fails to remove
any item within the time specified,
unless other arrangement
are made, ESU
may dispose or donate
such item(s), with no reimbursements.
|
Full payment on purchased items is due prior to
leaving the auction.
We accept
CASH and/or ALL MAJOR
CREDIT and DEBIT CARDS.
|
All responsibility
on purchased items is passed to the buyer
immediately
upon award of bid.
Please take items of
concern immediately to your car or keep it safe.
|
Though all description and commentary are believed
to be correct, neither auctioneer nor seller makes
any warranties or representations with respect to
the property and shall not be held responsible for
having made or implied any warranty of description,
authenticity,
authorship, attribution,
origin, condition, etc.
Bid at you own risk!
|
Neither auctioneer nor seller may be liable for any
personal injury on the sale premises. Bidder assumes
all risk and liability from the use of the items
sold, and shall indemnify,
and hold harmless,
seller and Auction Company and Staff from any
liability.
|
In the event auctioneer is required to employ an
attorney to enforce any term of this agreement,
purchaser agrees to pay reasonable attorney's
fees.

By signing this registration agreement,
I the undersigned,
agree
to pay for all items purchased using my bidder's
card. I understand that once I purchase an item, it
is my responsibility to keep it safe from damage or
loss. I understand that I may take these items to my
vehicle
prior to paying for them in
order to keep them safe.
I accept the
terms and conditions
as printed above for this and all future sales I attend,
and have received a copy of these
terms and conditions
for my records. |
